CONSTANT CONTACT AND ENTERPRISE NATION: SMALL BUSINESS, BIG BREAK TERMS AND CONDITIONS
(the Terms and Conditions)
1. The Administrator
The administrator of the programme is:

2. The programme
2.1. The title of the programme is Small Business, Big Break’ (the "programme").
2.2. The Programme is intended to offer a comprehensive prize. Participants will be able to select if they want to apply only to the marketing package, including 12 months of Premium access to Constant Contact, a £2,000 grant “Grant” to support their ambitions for growth and access to a marketing consultant, worth £500 or if they want to also be considered to have their TV ads created and broadcast on Channel 4. The programme is open to all eligible business owners. Entry will be by submission (via the administrators' website at https://www.enterprisenation.com/small-business-big-break/) of a fully completed application for the programme in accordance with Section 3, below (each an “Application”).
2.3. The prize will be funded by Constant Contact or an affiliate thereof (the “Sponsor”) and distributed to you by the Administrator.
2.4. All Applications for the marketing package and TV ad received between the Opening Dates and Closing Dates (as defined in Section 3.1, below) will first be assessed by the Administrator (on its own or using a third-party agent) for eligibility (in accordance with Section 4). All eligible Applications will then be shared with a judging panel that will select the 10 winners that will receive the marketing package.
2.5. From the 10 winners, those who opt in for a TV ad will be invited to an in-person pitch session. A panel of successful entrepreneurs and business leaders will then select three winners to have their ad created and aired on Channel 4.
2.6. The final decision to offer the prize will be at the discretion of the Administrator, acting reasonably.
2.7. Channel 4 is not responsible for administering the competition and is only involved in part-funding the prize.
3. How to enter
3.1. The competition will run on the following date: Opens 3 April 2025 10 AM (GMT) and closes 15 May 2025 04:59:59 PM (GMT)
3.2. All Applications must be received by the Administrator via the Administrator’s website by no later than 04:59:59 PM (GMT) on the Closing Dates above. All Applications received after the Closing Date will be automatically disqualified.
3.3. All applications must contain all of the required information set out on the application form on the Administrator’s website. Applications which do not contain all required information will be automatically disqualified.
3.4. There is no charge to use the Administrator's website or to submit an application. Applicants will be able to delete their account at any time, although a membership account is required to participate in the Programme.
3.5 All Applicants who complete an Application will have the option to receive free access to membership of the Administrator’s website and business support network, as set out in the Administrator’s Terms of Membership.
3.6. The Administrator and the Sponsor are not responsible for any partially-complete or failed Applications, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.
3.7. By submitting an application, you, applicants are bound by these Terms and Conditions and confirm that the information provided as part of the application is complete and accurate.
4. Eligibility
4.1. The Programme is only open to business owners in the UK who meet the following requirements (an “Eligible Business”):
4.1.1. you must be based in the UK and have a British bank account;
4.1.2. you must be 18 years old or over;
4.1.3. your company must have been trading for at least 3 months before the application date;
4.1.4. you must be registered either as a limited company with Companies House or as a sole trader with HMRC and have a unique tax reference number;
4.1.5. you must not be in the gambling and arms sectors;
4.1.6. you must ensure your products, ideas, or services comply with all applicable laws and regulations;
4.1.7 if requested, would be willing to share their success story of how they used the prize which may be further utilised and published by Enterprise Nation and Constant Contact for various purposes such as marketing, advertising and PR, and brand awareness, and;
4.1.8 you, or a member of your household (whether or not you’re related), or any of your immediate family members must not be an employee of or associated with either Constant Contact or Enterprise Nation.
4.2. The application must be completed and verified by one of the Eligible Businesses owners, who must be an individual natural person over the age of 18.
4.3. In applying for the Programme, the applicant confirms that they meet the requirements set out in Section 4.1 and that they are eligible to apply for the Programme. Applicants may be required to provide proof that they meet the requirements set out in Section 4.1.
4.4. The Administrator will not accept applications that are:
4.4.1. automatically generated by a computer;
4.4.2. completed by third parties or in bulk; or
4.4.3. incomplete.
4.5. There is a limit of one application to the Programme.
4.6. The Administrator and the Sponsor reserve all rights to disqualify Eligible Businesses from the Programme if their conduct is contrary to the spirit or intention of the Programme or if they provide any false or misleading information in their application.
5. The grant
5.1. A total of 10 grants of £2,000 will be offered to the Successful Applicants of the programme.
5.2. The payment of each Grant after completion of the Programme described in Section 5, shall be subject to the following conditions:
5.2.1. provision by the Successful Applicant of proof of any information submitted in the relevant Application, on request of the Administrator;
5.2.2. continued compliance of each Successful Applicant with the criteria for Eligible Businesses set out in Section 4.1 and with these Terms and Conditions;
5.2.3. the entering into between each Successful Applicant and the Administrator of a Grant Agreement;
5.2.4. the compliance of the Successful Applicant with the Grant Agreement, once entered into; and
5.2.5. the Successful Applicant having a British bank account and providing the Administrator with the relevant details of such account, along with any other information reasonably requested by the Administrator to facilitate the payment of the Grant.
5.3. There is no alternative award to a Grant. Grants will be paid to Successful Applicants via bank transfer, payable to the account notified to the Administrator in accordance with Section 5.6.
5.4. Grants are not negotiable or transferable and must be used solely for the purposes detailed by the applicant company in the Application. The Administrator reserves the right to take action to recover the Grant if a Successful Applicant is in breach of these Terms and Conditions or otherwise fails to use the Grant for the specified purposes.
5.5. Successful Applicants who, after being notified of their success, do not fulfil the requirements of Section 5.2, do not respond to the notification within 7 days, decline the Grant or refuse to sign a Grant Agreement shall no longer be eligible to claim a Grant and shall be automatically disqualified from the Programme. In such circumstances, and at the sole discretion of the Administrator and Sponsor, the relevant Grant may be offered to the highest-rated runner-up Application (under the Section 2 judging process), subject to the terms of this Section 5.
5.6. Grants may be taxable, and Successful Applicants are responsible for declaring and paying any taxes due.
6. Successful applicants
6.1. The decision of the Administrator is final, and no correspondence or discussion will be entered into, except with Successful Applicants. The Administrator is unable to provide individual feedback on any application.
6.2. The Administrator will contact Successful Applicants as soon as practicable after the closing date using the contact details provided with the Application.
6.3. Upon completion of the Programme, the Administrator will confirm the relevant details of each Successful Applicant, and provide each Successful Applicant with a completed copy of the Grant Agreement.
6.4. Successful Applicants must sign and return to the Administrator the signed Grant Agreement within 30 days of receipt. The Grant Agreement will then be counter-signed by the Administrator, and the Grant will then be transferred to the Successful Applicant in accordance with the terms of the Grant Agreement. If the signed Grant Agreement is not returned to the Administrator within the 30 day period, the Administrator may, in its sole discretion, withdraw the offer of the Grant and disqualify the relevant Successful Applicant.
6.5. After the completion of the Programme and the entering into of all Grant Agreements, the Administrator may publish on their websites the names of all Successful Applicants who take part in the Programme and receive a Grant, and the Administrator and/or Sponsor may issue press releases or other publicity with details about the Programme and/or Grant.
6.6. If an applicant objects to its details being published or made available, please contact the Administrator at hello@enterprisenation.com.
6.7. The Administrator and Sponsor do not accept any responsibility if any Successful Applicant is unable to take up or declines to accept any Grant or fails to receive notification of or accept a Grant due to any technical issue or as a result of having provided incorrect/incomplete contact details.
7. Ownership of programme entries and intellectual property rights
7.1. The Administrator and Sponsor do not claim any rights of ownership in the content of any Application.
7.2. The Sponsor owns all intellectual property rights in any Programme Promotion (as detailed below).
8. Data protection and publicity
8.1. The Administrator will only process personal information submitted to it as set out in its privacy policy.
8.2. Information provided by applicants in the application will be shared with the Sponsor, for the performance of the Programme and, if applicable, to enable the Sponsor to arrange and undertake Programme Promotion (as detailed below). The Sponsor will act as a data controller for the personal data it receives from the Administrator on an applicant’s behalf and that it collects to facilitate an applicant’s application for and/or participation in the Programme and the Programme Promotion. 8.3. In accordance with Sections 6.5 and 6.6 above, and unless the Applicant exercises its objection right set forth in Section 6.6 above, the Applicant grants the Administrator and the Sponsor the right, with no obligation, to the use of their name, image, photograph, likeness, biographical information, statements attributed to them (if true) and any video footage related to the Programme for all advertising, promotional or other commercial purposes by the Sponsor and the Administrator, their affiliates and/or related third parties in all media now or hereafter known, worldwide and in perpetuity without additional compensation (“Programme Promotion”).
9. Disclaimer; limitation of liability
The Programme, and all the information accessible through it, is provided for informational purposes only on an “as is” and “as available” basis. The Administrator, the Sponsor and their affiliates and agents make no warranties, representations or guarantees of any kind, express or implied, including, but not limited to, in respect of the accuracy, currency, completeness or operation of any information, materials, content, availability, and products shared or used in connection with the Programme. Insofar as permitted by law, the Administrator, the Sponsor and their affiliates and agents disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.
The Programme and/or any of its features may be unavailable or interrupted from time to time. The Administrator and the Sponsor are not responsible for any unavailability, interruptions or errors in respect of the Programme, its features or any Grants.
Insofar as permitted by law, the Administrator, the Sponsor and their affiliates and agents will not in any circumstances be responsible or liable to compensate any applicants or accept any liability (whether direct, indirect, special, incidental, exemplary, punitive or consequential) for any loss or damage arising out of or in connection with an applicant’s application to, or participation in, the Programme (including any Programme Promotion), whether such liability arises from any claim based upon contract, warranty, tort (including negligence), strict liability or otherwise, and whether or not the Administrator or the Sponsor, their affiliates or agents have been advised of the possibility of such loss or damage. Statutory rights are not affected.
10. General
10.1. If there is any reason to believe that there has been a breach of these Terms and Conditions, the Administrator and the Sponsor may, at their sole discretion, reserve the right to exclude any applicant from participating in the Programme.
10.2. The Administrator reserves the right to hold void, suspend, or amend the Programme (including these Terms and Conditions) where it becomes necessary to do so for reasons outside the Administrator's control. The Sponsor reserves the right to hold void, suspend, or amend the Programme (including these Terms and Conditions) where it becomes necessary to do so as determined in its sole discretion.
10.3. The Terms and Conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England.
